La Cassazione, con la sentenza numero 11504/17 pubblicata oggi in materia di assegno di divorzio, stabilisce nuovi parametri di riferimento per il riconoscimento dell’assegno di divorzio.
Nello specifico, la prima sezione civile ha superato il precedente consolidato orientamento, che collegava la misura dell’assegno di mantenimento al parametro del “tenore di vita matrimoniale”, indicando come parametro di spettanza dell’assegno, avente natura “assistenziale”, l’”indipendenza o autosufficienza economica” dell’ex coniuge che lo richiede.
Si tratta di una sentenza storica secondo l’avvocato e presidente dell’associazione matrimonialisti italiani, Ettore Gassani Con la decisione delle Cassazione “viene cancellato il criterio del tenore di vita per quantificare e riconoscere l’assegno divorzile”.
“Potrebbe scomparire d’ora in poi – aggiunge Gassani – un principio cardine della legge sul divorzio. La storia dei soldi dati per la separazione è una storia lunga. Ma la decisione dei giudici della Suprema corte può fare scuola, bisogna ammetterlo.
Anche se negli ultimi anni c’è stata una tendenza chiara. Perché negli anni ’80 la concessione dell’assegno era per il 60 per cento delle coppie”.
Ma il dato è molto diminuito con il tempo. “Tanto che nell’ultimo anno è del 19 per cento”. Gassani, che è autore dei saggi “I Perplessi Sposi” e “Vi dichiaro divorziati” aggiunge: “In questo senso la Cassazione spesso è un termometro della situazione sociale del Paese. Perché le donne, in tanti casi, lavorano e guardagnano più degli uomini. Inoltre questo verdetto è in linea con la realtà europea”.
Stante il fatto che il criterio dell’assegno divorzile “è stato spazzato via”, continua Gassani, va ricordato che “le coppie con stipendi fissi hanno solo l’assegno per i figli; sono quelle ricche, fatte di vip, professionisti e commercianti a giovarsi di questa pronuncia. La Cassazione comunque eleva l’asticella culturale, il matrimonio non è un affare. Se si vive insieme è un conto, insomma, ma l’assegno viene concesso con oculatezza”.
