Al culmine di una lite in casa, le diede fuoco. E’ una delle tante atroci storie di violenza contro le donne, accaduta alla periferia della capitale, nel giorno di Natale 2014. Adesso la prima Corte d’assise d’appello di Roma ha condannato a 16 anni di carcere il romeno Felix Haida, riducendo la pena a 30 anni inflitta dal gup in primo grado, per l’omicidio della convivente, Carmen Saran. Abbiamo chiesto a Fabrizio Peronaci, capo della Cronaca nera del “Corriere della Sera” e autore di libri d’inchiesta, un commento sulla vicenda.
Lui uccise per gelosia, e fu una vendetta orrenda: versò una tanica di benzina addosso alla sua compagna, Carmen, e le lanciò addosso l’accendino. La guardò bruciare, forse in cuor suo si pentì, poi inventò una scusa che non convinse nessuno: la fidanzata aveva preso per errore una bottiglia che conteneva benzina, pensando fosse vino, e l’aveva avvicinata alla bocca per berla, mentre stava fumando. Carmen morì in ospedale, dopo un mese di atroci sofferenze, con il volto, le braccia, il petto sfigurati dalle fiamme. E lui, Felix l’assassino, adesso merita una riduzione di pena, perché, insomma, il primo verdetto era stato eccessivo, la motivazione del delitto non è stata poi così “futile”.
Contiene un paradosso ineffabile, che ci riporta ai delitti d’onore di mezzo secolo fa e al famigerato articolo 587 del codice Rocco, la sentenza d’appello pronunciata a Roma, che ha quasi dimezzato la condanna dell’autore dell’omicidio. Felix Haidau, romeno, 43 anni, in quel maledetto giorno di festa di quasi due anni fa reagì come solo gli uomini forti, infuriati e sicuri del fatto loro sanno fare. Voleva punire la sua donna per quel che lei gli aveva appena confessato, essere stata a letto con un altro. E ci riuscì.
Nel primo verdetto, emesso al termine del rito abbreviato, l’aggravante dei “futili motivi” fu riconosciuta dal gup: 30 anni di carcere. Ma adesso, in secondo grado, è arrivata la mano leggera: l’aggravante è caduta e la pena è stata ridotta a 16 anni di detenzione. Quattordici in meno. Uno sconto notevole, per molti versi sorprendente, che sollecita una riflessione alla vigilia della Giornata internazionale contro la violenza alle donne.
Dunque, cosa ci insegna il martirio di Carmen? Se appiccare il fuoco sulla propria compagna colpevole di tradimento non configura il “futile motivo”, cosa si deve dedurre? Che un omicidio del genere è meno grave e socialmente riprovevole? Se la poveretta si fosse macchiata di una “colpa” diversa (che so, lasciare scuocere la pastasciutta), la condanna sarebbe forse stata maggiore? Cos’è più grave, nell’infinito campionario delle violenze e delle punizioni domestiche? Quale la graduatoria degli orrori? E infine l’ultima, la più insidiosa: la rabbia dell’uomo tradito, in fondo, merita un’attenuante?
